A12 Disciplinary case - Mr T MCGougan

At its meeting on 24 September 2015, the Kennel Club Disciplinary Sub-Committee considered the convictions of Mr T McGougan of Andover, from the East Dorset Magistrates Court for offences contrary to the Consumer Protection from Unfair Trading Regulations 2008.

The Committee imposed the following penalties:


To disqualify him from exhibiting at, taking part in, attending and/or having any connection with any event licensed by the Club. If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification

To disqualify him from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club

To disqualify him from acting as an Officer or serving on the committee of any canine society

[A11 j (6)]


To disqualify him from taking part in the management of any event licensed by the club

[A11 j (7)]


To disqualify him from judging at any event licensed by the Club

[A11 j (8)]


To disqualify him from effecting registrations of any or all dogs and/or progeny of such dogs which are owned and/or registered by him (whether or not jointly owned and/or whether or not owned and/or registered in the name of a nominee)

The above listed disqualifications are to be for six years from 24 September 2015.

The Committee noted that Mr McGougan did not respond to the referral under Rule A12 and therefore no mitigation or contrition has been expressed.

The Committee considered that for a breeder to deliberately mislead and not provide vital information to a purchaser of a Kennel Club registered dog about the health and known condition affecting a puppy is a serious matter.

It undermines the confidence and trust which a puppy buyer is entitled to have when buying a Kennel Club registered dog.
