A11 Disciplinary Case – Allan And Spence

At its meeting on 25thJune 2015, the Disciplinary Sub-Committee considered a complaint brought by the Kennel Club under Kennel Club Rule A11 a (1) (c) against Mr David Allan, Mrs Linda Allan, Mr Lex Spence and Mrs Irene Spence, as committee members of the St Bernard Club of Scotland, that they behaved discreditably and prejudicially to the interests of the canine world in that they disregarded and did not comply with directives issued by the General Committee on 18thNovember 2014.

The complaint was upheld and the Committee imposed the following penalties:

To warn them as to their future conduct

To censure them

[A11 j (2)]

To fine Mr and Mrs Allan the sum of £500

To fine Mr and Mrs Spence the sum of £500

To disqualify them from exhibiting at, taking part in, attending and/or having any connection with any event licensed by the Club. If any person disqualified under this sub-paragraph shall attend any canine event whilst disqualified the General Committee shall have the power to increase the period of disqualification

To disqualify them from being or becoming a member of any canine club or society registered with or affiliated to the Kennel Club

To disqualify them from acting as an Officer or serving on the committee of any canine society

[A11 j (6)]

To disqualify them from taking part in the management of any event licensed by the club

[A11 j (7)]

To disqualify them from judging at any event licensed by the Club

[A11 j (8)]

 

The above listed disqualifications are to be for five (5) years from
25th June 2015.

The Committee, following the imposition of these penalties, would draw the attention of the Respondents to the effect of Rule A11 sub-section n.

St Bernard Club of Scotland

General Committee Directives

The Committee issued the following directives to the club
(vide Regulations C2.f.; C3.a.(2);C3.a.(11); C3.a.(14): C4.a.(1)(c); C6.a.).

  1. That the club must process all outstanding membership renewals without further delay.
  2. That the club must process the requisition for a Special General Meeting and convene the meeting at a mutually agreed time, date and venue.
  3. That the club must submit membership lists for 2013 and 2014.
  4. That the club must confirm the current composition of the committee, and submit the dates and minutes of committee meetings at which any co-options were approved.
  5. That failure to comply within seven days may result in suspension of the club. Under Regulation C6.b. the club may make written representation to the General Committee for consideration at its meeting on 6 January 2015.

 The directives were intended to assist and move the St Bernard Club of Scotland forward. This was met with intransigence and with no co-operation from the officers of the club. The officers made no attempt to comply with the directives. This is a source of disappointment and is entirely unacceptable.

It is fundamental that members of any registered society should be able to rely upon the Kennel Club's protection and the General Committee's authority in upholding the regulations supporting registered societies.
